Product suitability

Please note that all products on the Porta-Gym website are designed for personal bodyweight resistance exercises and carry a personal use warranty only. The warranty is null and void for use other than personal bodyweight resistance exercises.

Safety

Like any exercise equipment, or indeed any equipment, there is always a risk of injury or damage if used improperly or without due care. Use of the Porta-Gym in any way is at the user’s own risk and it is the sole responsibility of the user to handle and use the Porta-Gym with due care and attention. An instruction guide / user manual is made available on how to set-up, pack-up, and use your Porta-Gym safely and it is the sole responsibility of the user to observe these instructions and the spirit of the guidance. Porta-Gym Limited accepts no liability for any damage or injury that occurs while using the Porta-Gym or any part thereof.

Condition of goods

Due to the complexity of the manufacturing and assembly processes, we cannot guarantee that each Porta-Gym will not have small cosmetic imperfections such as slight discolourations on the steel or small marks in the powder coating paint. Such imperfections are purely cosmetic and should be considered normal for new Porta-Gyms.

VAT

All products listed in our retail shop are priced inclusive of VAT where applicable.

Warranties

All new equipment sold by Porta-Gym Limited is covered by a one year parts warranty as standard, although the term may be extended beyond one year as part of promotional campaigns. The number of replacement parts per customer is limited to four items overall, with a specific limit of one for the slings/suspension straps. In most cases, we will send a part by mail for the customer to fit. Evidence of the fault must be provided and we reserve the right to request that the faulty part be sent to Porta-Gym Limited business premises for inspection prior to replacement. Warranties will be honoured whenever the claim is reasonable and damage or fault has occurred during normal reasonable usage. This warranty excludes damage caused by accident or misuse. Porta-Gym Limited reserves the right to cancel warranties if equipment is used for other than personal bodyweight resistance exercises.

If an item develops a fault, please contact us stating a brief description of the fault. Porta-Gym Limited will either arrange to send a part for the customer to fit, send an engineer to site, or ask that the goods be returned to our warehouse for examination. Goods must be well packaged prior to collection. Goods may not be accepted into our premises without prior agreement. We will repair or replace the equipment with an equivalent or better model and deliver the goods back to the customer at our expense.

All equipment is warranted for mainland UK use only.

Data protection

All customer information will be treated under the terms of the Data Protection Act. We will not pass on your details to other companies. We may identify and inform you of other products and services offered by Porta-Gym Limited which would be of interest to you. You must tell us if you do not wish us to do so.

We do not store credit card details nor do we share customer details with any 3rd parties.

Complaints and returns

Porta-Gym Limited values its customers and will endeavour to ensure that they are fully satisfied with their service and goods. However, if you feel you have something to complain about, please contact us using any email addresses on the website.

All prices quoted are correct at time of going to press. Prices may change, however, including due to a change in the rate of Value Added Tax. The price levied will be confirmed at the time of ordering.

We will strive to keep the products listed on our website in stock at all times. Occasionally some items may be out of stock, and in these circumstances we will endeavour to make this clear on the website. If you order an item that is out of stock, we will contact you within 48 hours (2 working days) and advise you when the item is due back in or of any comparable product that is available, or provide a full rebate.

For returns, refunds will be made in the original payment method and within 14 days of our receipt of goods.

Shipping

We dispatch products from Monday to Saturday. We do not ship on certain public holidays. We will endeavour to dispatch orders by courier/parcel delivery service within three working days, but this may vary depending on stock and workforce availability, Because we are a family business with a small workforce, time between order and dispatch may increase at times of high demand, which we will make clear on the website at the time of ordering. We will notify you of the intended dispatch date, and keep you updated as appropriate, by sending you an email to the email address provided by you at the time your order was placed.

Upon delivery, please inspect the packaging for damage. If it appears that the products inside are damaged, please refuse to accept the shipment.

We currently offer a single flat UK shipping rate and a single flat international shipping rate. Incorrect/faulty goods must be returned to us before replacements will be dispatched.

You can cancel the order at any time prior to dispatch date.

Your statutory right to cancel or return

Under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations, you have the right to cancel most products purchased from us using distance means and receive a full refund within 14 days of delivery. We must be notified of your intention to cancel in writing or email and the cost to return the goods will be the responsibility of the customer. We also reserve the right to make a deduction from refunding the full purchase price if we believe (on examination of the returned goods) that they exhibit signs of use. The amount of deduction will be based on the extent of the diminishment in the goods’ value.

Under the terms of the aforementioned regulations, you have the right to cancel any service (purchased using distance means) we offer and obtain a full refund less shipping costs within 14 days beginning the day after the contract is concluded. In exceptional circumstances, as identified by Porta-Gym Limited, customers may not be charged shipping costs.

If goods have been dispatched but not used, we also offer customers the opportunity to return goods beyond 14 days but no later than 30 days of receipt of your goods. In cases such as this the following conditions will apply. The cost of postage, packaging and insurance to return the goods will be borne by the customer and goods must be received by us in perfect condition and in their original packaging. The cost of delivering the goods will be deducted from any refund. If goods are not received back in perfect condition and in their original packaging, Porta-Gym Limited reserve the right not to accept the goods at our premises and/or not to issue a full refund or credit. Any costs to redeliver the goods will be payable in advance by the customer. If the goods have been removed from their original packaging or show signs of use, your option to cancel may be forfeited.

Our 14-30 day return options apply to goods purchased for domestic, personal use only. These options do not apply to equipment purchased for use by a business or as commercial equipment. Any free gifts received with your order must be returned if an order is cancelled.

All order cancellations or returns must be notified to our Support team by email or by writing. If you wish to cancel or return goods, please email our Customer Service Department at support@porta-gym.co.uk and we will issue a return authorisation email. Goods must be returned to us within 7 days of receipt of this authorisation.

No cancellation of order will be accepted after 30 days from delivery of goods.

Disclaimer

Porta-Gym Limited will endeavour to keep product information as up to date as possible. However, specifications might change without notice. Product photographs are intended to illustrate product faithfully, but may occasionally not exactly reflect the product as sold.

While every effort is made to provide accurate and up-to-date information, Porta-Gym Limited cannot be held responsible for any errors or omission on our website or brochures.

Although Porta-Gym Limited endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If a pricing error is discovered or an order is placed at the erroneous price, we may supply the goods at said erroneous price on a goodwill basis, but at our discretion we may alternatively contact you and ask you whether you wish to cancel your order or continue with the order at the correct price or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

All orders made by you through the website are subject to acceptance by us. We may choose not to accept your order for any reason and providing no payment has been taken nor any explicit acceptance of your order has been accepted. We will not be liable in those circumstances.

After submitting an order to us we will send you an order acknowledgement email with details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order.

Any email or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order.

While every care is taken to ensure that this website is virus-free, Porta-Gym Limited accepts no liability for viruses or virus damage as result of using this website.
